- Your deposit is non-refundable. It secures your place in the schedule.
- Timelines depend on your feedback. Quick replies keep your project on track.
- Your files are fully yours once the project is paid in full.
- Digital products and templates cannot be refunded once downloaded.
- Payments run through Stripe and Klarna. Your card details never touch this site.
1. Introduction
These Terms & Conditions and Privacy Policy govern your use of and purchases from www.katedesignedit.com (the "Site"), operated by Kate Designed It ("we," "our," "us"). By using or purchasing from this Site, you agree to comply with these Terms in full. We may update them periodically and any changes will take effect immediately upon being posted.
2. Orders and Acceptance
All purchases made through this Site constitute an offer to buy under these Terms. We reserve the right to refuse or cancel any order at our sole discretion. Once payment is confirmed, you will receive either an automatic download link or a delivery email containing your digital files, depending on the product purchased.
3. Premade vs Custom Digital Products
We offer two types of digital products:
- Premade Digital Products, including premade AI images and digital downloads such as our ebook, are available for immediate download upon payment. Files are delivered automatically and no further action is required from you.
- Custom Digital Products, including bespoke AI-generated images, require a completed project brief before work begins. Following payment, you will receive a brief form covering your requirements, references, and style direction. Work begins once your completed form is received. Custom products are created specifically to your brief and are non-refundable once production has begun. Delivery timelines will be confirmed upon receipt of your completed brief.
4. Prices and Payments
All prices are listed in GBP and may change at any time without notice. Payment must be made in full before access to any digital product is granted. By completing a purchase you confirm that:
- The payment information provided is accurate and authorised
- You have sufficient funds or credit to complete the transaction
- All charges incurred are your responsibility
5. Digital Delivery
Premade digital products are delivered immediately upon payment via automatic download link. Custom digital products are delivered within the timeframe confirmed after your brief is received. It is your responsibility to download and securely store your files. We cannot reissue download links or access after 14 days of delivery.
6. Refund Policy
Due to the nature of digital products all sales are final. Digital products, templates and guides are non-refundable once the file has been downloaded or the download link has been issued. No refunds, cancellations, or exchanges will be issued once a purchase has been made or once production of a custom order has begun. Refunds will only be issued if we are unable to fulfil your order due to circumstances on our end.
Deposits on branding and website projects are non-refundable, as they secure your place in the studio schedule and cover the work that begins immediately after booking.
7. Consultations and Bookings
The Project Discovery Call is a free 20-minute fit call covering services, process, timelines and which option suits you. It is not a strategy, audit or advisory session, and personalised recommendations are not included. Bookings can be rescheduled or cancelled free of charge with at least 24 hours' notice using the links in your confirmation email. With less than 24 hours' notice, one reschedule may be offered at our discretion. No-shows release the slot and may not be rebooked.
The Business Priority Session is a paid 45-minute advisory session. The fee is non-refundable once the call has taken place, whether or not you go on to book a service. The fee is fully deducted from your final balance when you proceed with a Brand Identity or Website Design service within 7 days of the call; it does not apply to any other service. Rescheduling is free with at least 24 hours' notice; with less than 24 hours' notice one reschedule may be offered at our discretion. Where a session is missed without prior notice, the fee is forfeited and is not eligible for rescheduling or refund. Exceptional circumstances are considered on a case-by-case basis.
8. Licence, Ownership and Bespoke Work
Premade digital products — including premade AI image packs, templates, guides and ebooks — are licensed, not sold. You are granted a non-exclusive, non-transferable licence to use them for your own personal or business purposes only. This licence does not grant ownership of the underlying design, structure, or creative concept, and you may not claim any template or premade design as your own original work.
Bespoke design work — including Brand Identity and Website Design projects created to your brief — is different. Full ownership and commercial rights in your final delivered designs, including the right to trademark your final logo, transfer to you once final payment is received and your files are delivered. Unused concepts, draft routes and working files remain the property of Kate Designed It.
8a. Feedback, Revisions and Project Timelines
Each project includes 3 rounds of changes per section. All feedback sent in one go counts as one round. Additional rounds are £35 each and are paid before the round begins.
- Feedback on each design round is due within 3 business days (72 hours) of the drafts being sent
- A reminder is sent on day 2, and a final request on day 3
- If no feedback is received by day 4, your delivery date is rescheduled around existing studio bookings
- If no feedback is received by day 7, the project is placed on hold until you are ready to continue; your work is kept safely and resumes in the next available slot
You confirm that any text, photographs, logos or reference material you supply is owned by you or properly licensed for this use. We accept no liability for third-party copyright claims arising from material you supply.
9. Prohibited Use and Resale
You are strictly prohibited from:
- Purchasing any product with the intention of reselling, redistributing, sublicensing, or including it in another product or service
- Uploading, sharing, or distributing our digital files on any public or private platforms, file-sharing sites, or marketplaces
- Altering, modifying, or rebranding our products for resale under your own or another brand name
Any violation will result in immediate termination of access and may lead to legal action and financial penalties.
10. Intellectual Property Rights
All designs, layouts, templates, graphics, and digital content on this Site are and shall remain the intellectual property of Kate Designed It. No part of this website, its content, branding, or materials may be reproduced, distributed, or transmitted in any form without the prior written permission of Kate Designed It, except in the case of brief quotations used in reviews and certain non-commercial uses permitted by copyright law.
11. Account and Access
Your account and downloads are for individual use only. You may not share login details, download links, or purchased files with others. Any account found engaging in such activity may be suspended or permanently revoked without refund.
12. No Warranties
All digital products are provided "as is" without warranty of any kind, express or implied. Kate Designed It does not guarantee that our products will meet your expectations or achieve specific results. You assume full responsibility for how you use and apply our products.
13. Limitation of Liability
In no event shall Kate Designed It be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our products, including but not limited to loss of revenue, data, or business opportunity.
14. Ethical Use
Our products and designs may not be used in connection with unlawful, offensive, or misleading content. We reserve the right to revoke access and take action against any use that damages our brand integrity or violates applicable laws.
15. Data Collection and Privacy
When you make a purchase or sign up on our Site, we collect limited personal information such as your name, email address, billing address, and phone number. This information is used solely to:
- Process and fulfil your orders
- Deliver digital products
- Provide customer support and essential service updates
We do not sell, trade, or rent your personal information to third parties. Your data may be securely stored and processed through our website platform, payment processors, or email service providers, all of which comply with UK GDPR and relevant data protection laws. By submitting your information, you consent to its collection and use in accordance with these Terms. 17. Security
We use appropriate technical and organisational measures to protect your personal information from unauthorised access, alteration, or disclosure. However, no system is entirely secure and you acknowledge that transmission of data over the internet is done at your own risk.
18. Retention of Information
We retain personal data only as long as necessary to fulfil the purposes outlined in these Terms, comply with legal obligations, and resolve potential disputes. When data is no longer required it is securely deleted or anonymised.
In practice, enquiry and consultation records are kept for up to 24 months, and order and invoice records are kept for 6 years as required for tax and accounting purposes. Marketing email records are kept until you unsubscribe.
Payments are processed by Stripe and Klarna. Your full card details are never seen by, sent to, or stored on this Site.
19. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
20. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
21. Acceptance of Terms
By accessing or purchasing from Kate Designed It, you confirm that you have read, understood, and agreed to these Terms & Conditions and this Privacy Policy in full.
